Terms of sales

These terms of sale are entered into by, on the one hand, the company Webtex SARL with a registered capital of 200,000 Euros, based in 2 Rue Dion Bouton, 26200 Montélimar (France) and registered under number 789 655 263 at Romans trade register, hereinafter “Webtex” and, on the other hand, any natural person or legal entity wishing to buy on the website , hereinafter “the buyer”.

Object

These terms of sale define contractual relations between Webtex and the buyer and are applicable to all purchases made through the website www.vondutch.fr, whether the buyer is a company or individual customer. Any purchase of a product or service through this website implies unreserved acceptance of these conditions by the buyer. These terms of sale prevail over any other terms and conditions, general or otherwise, that have not been expressly endorsed by Webtex. Webtex reserves the right to modify these terms of sale at any given time. In this case, the applicable conditions are those in effect on the date of the buyer’s order.

Characteristics of the goods and services on offer

The products and services available feature in the catalogue published on the website www.vondutch.fr. These products and services are offered within the limits of available stock. A description of each product is provided by Webtex. Although the photographs that appear in the catalogue are as accurate as possible, they cannot ensure perfect similarity with the offered product, especially as concerns the colours or patterns.

Prices

Prices listed in the catalogue are in Euros with tax included, based on the rate of VAT applicable on the date of the order. Any change to the rate of tax may have an effect on the price of goods and services. Webtex reserves the right to modify its prices at any time. However, the price that applies to the buyer is the price featured in the catalogue on the date of the order. Prices indicated do not include handling, carriage or delivery costs. We can only deliver to the countries listed below.

Online sales of the products and services presented on this website are reserved for buyers living in Andorra, Belgium, France Dom Tom, France Métropolitaine, French Guiana, Guadeloupe, Luxembourg, Martinique, Monaco, Réunion, Saint Bart, Saint Martin, Switzerland and can only be delivered to these countries.

The seller reserves the right to cancel any order or transaction if errors in the delivery address caused the delivery rates to be wrongly calculated. At no time whatsoever can money paid by the customer be considered as a deposit

Orders

The buyer wishing to purchase a product or service must:

– fill in the ID form with all requested details;
– fill in the online order form with all references for selected products or services;
– check then validate the order;
– carry out payment under the specified conditions;
– confirm the order and payment.

By confirming the order, the buyer accepts the present terms of sale, of which they certify their knowledge, and forgoes any claim on their own purchasing conditions or any other terms. All information provided and the registered confirmation stand as evidence of the transaction. Confirmation has the same worth as a signature and signifies acceptance of the operations carried out. The seller will confirm the order by email.

Cancellation clause

Individual and non-corporate buyers have a period of seven days from delivery of their order in which they have the right to return a product to the seller for exchange or reimbursement, without any penalties except the cost of returning the item.

Methods of payment

Payment is due at the moment of order.
Payment is made by bank card, via the secure system Cybermut which uses the SSL (Secure Socket Layer) protocol. Information is encrypted by software so that no third parties can access the information while it is being passed on.
At the buyer’s request, a paper invoice showing VAT can be prepared.

Delivery

Delivery is made to the address indicated on the order form, which must be situated in one of the countries specified above. Risks are at the charge of the buyer as soon as the products have left Webtex premises.
In the case of damages arising during transport, a justified claim must be made to the carrier within three days of delivery. Delivery times are approximate and provided for information purposes only. If products have not been delivered within thirty days of the order, the sales contract can be cancelled and the buyer reimbursed.

Warranty

All products supplied by the seller are covered by the legal warranty established by articles 1641 and onwards in the Civil Code. In the case of non-conformity of a product, it can be returned to the seller who will take it back and exchange it or reimburse the buyer. All claims and requests for exchange or reimbursement must be made by post at the following address: Webtex SAS - Service Internet - ZA de l'étang - 26780 Chateauneuf du Rhône - France within thirty days of delivery.

Returns

If you are not satisfied with a product, you must contact our hotline by email at retour@vondutch.fr and obtain consent, then return the product to us for it to be exchanged. For hygiene reasons, the articles must be returned in their original packaging, which must be complete and intact, and they must be in perfect condition for resale. Products that are not fit for resale will not be reimbursed or exchanged.

Responsibility

In the online sales process, the seller only has obligation of means. The seller will not be liable for any damages arising from use of the Internet, such as loss of data, intrusion, viruses, interrupted service or other unintended problems.

Nobody is authorised to reproduce, communicate or use in any way whatsoever, even partially, the elements contained in this website, whether they be software applications, visual or sound effects. Personal data

In keeping with the provisions of France’s Information Technology and Civil Liberties Act of 6 January 1978, personal data concerning buyers may be processed electronically. Webtex reserves the right to collect information about buyers and, to this end, may use cookies. If the company so wishes, it may pass on the information it collects to other commercial partners.
Buyers can oppose the disclosure of their personal data by contacting Webtex. In the same way and in accordance with the law dated 6 January 1978, users have the right to access and rectify information concerning themselves. The electronic processing of data, including management of email addresses of website users, was declared to the CNIL (the French administrative authority responsible for the application of the data privacy legislation) on 30/04/2010 and registered under the number 1771982.

Data storage - Proof

Webtex will archive order forms and invoices using reliable and long-lasting methods. This will constitute a true copy in accordance with article 1348 of the Civil Code. The electronic files held by Webtex will be considered by both parties as proof of communication, orders, payments and transactions between the parties.

Litigation and applicable legislation

The present terms of online sale are subject to French law. In the case of litigation, competence will be attributed to the competent tribunal in Paris, notwithstanding plurality of defendants or the introduction of third parties.
